Ignition Interlock Device Laws
- According to Massachusetts ignition interlock device laws, all repeat OUI offenders are required to install an interlock device on any vehicle they drive. In some cases, offenders may apply for a hardship license which reinstates limited driving privileges, provided that the offender installs an ignition interlock device.
- In all cases, the interlock device must remain installed during the term of the hardship license and for a period of two years after license reinstatement.
- Courts may also impose a requirement to install an interlock device for any offender, for any period of time, at the discretion of the court.
License Suspension
Administrative Suspension
DUI laws in Massachusetts state that drivers who are stopped for suspicion of operating under the influence (OUI) will face an automatic 45 to 90 day license suspension if they register a BAC of .08% or higher on a field breathalyzer test or if they refuse to take the test.
Drivers under the age of 21 will be charged with OUI and be subject to the suspension if they have a BAC of .02% or greater.
Judicial Suspension
Upon conviction for OUI, drivers face additional court-ordered license suspension.
